Purpose #

The Advertising Restriction Policy aims to ensure that gambling advertisements are conducted in a responsible manner, protect vulnerable groups (including minors), and maintain the integrity of the gambling industry in Vanuatu.

Scope #

This policy applies to all forms of advertising and promotional activities related to gambling services regulated by the department of Customs and Inland Revenue and administered by Vanuatu Gaming Authority. It includes, but is not limited to, digital advertising, television, radio, print media, social media, sponsorships, and direct marketing.

General Advertising Guidelines #
Honesty and Fairness #
  • Advertisements must be truthful, clear, and not misleading. They should not imply that gambling is a guaranteed way to achieve financial success or social status.
  • Operators must ensure that all terms and conditions of promotional offers are clearly stated and easily accessible.
Protection of Vulnerable Groups #
  • Advertising should not be directed towards, nor designed to appeal particularly to, individuals under the legal gambling age.
  • Advertisements must not exploit the susceptibilities, aspirations, credulity, inexperience, or lack of knowledge of minors and vulnerable individuals.
  • Operators must not use images, themes, or language that could appeal to minors or that are associated with youth culture.
Responsible Gambling #
  • All advertisements must include messages promoting responsible gambling, such as “Gamble Responsibly” or equivalent.
  • Operators must provide information about support services and self-exclusion options in their advertisements.
Specific Restrictions #
Content Restrictions #
  • Advertisements must not portray gambling as an essential part of a person’s life, or as a solution to financial, social, or personal problems.
  • They must not depict gambling in a way that suggests gambling is a rite of passage or a means to achieve sexual success or enhanced attractiveness.
  • Advertisements must not imply that gambling can enhance personal qualities, such as self-esteem, social standing, or employment prospects.
Audience Restrictions #
  • Advertisements must not be placed in media outlets, websites, or timeslots primarily directed at minors or where minors are likely to comprise a significant portion of the audience.
  • The use of celebrities, influencers, or characters appealing particularly to minors is prohibited.
Sponsorship and Endorsements #
  • Sponsorship agreements and endorsements must comply with all advertising guidelines and should not promote gambling to minors or vulnerable groups.
  • Sponsorship of events or activities where minors are the primary participants is strictly prohibited.
Bonus and Promotion Advertising #
  • Advertisements for bonuses and promotions must clearly state any significant terms and conditions. They should not create a false impression of the benefits of gambling or the ease of winning.
Monitoring and Compliance #
  • The Vanuatu Gaming Authority will monitor advertising practices and take action against operators found in breach of this policy. This may include issuing warnings, fines, or revoking licenses.
  • Operators are encouraged to have internal compliance teams review advertisements before publication to ensure adherence to this policy.
Reporting and Enforcement #
  • Operators must report any breaches of this policy to the Vanuatu Gaming Authority immediately.
  • The Vanuatu Gaming Authority reserves the right to require the modification or withdrawal of any advertisement that does not comply with this policy.
Review and Updates #
  • This policy will be reviewed periodically to ensure it remains effective and in line with best practices and legal requirements. Operators will be notified of any changes or updates.
